1. Introduction
Welcome to GlowaGirlz (“GlowaGirlz”, “we”, “our”, or “us”).
GlowaGirlz is an online beauty and lifestyle platform designed to connect Clients seeking professional beauty services with skilled and verified independent Service Providers (“Artists”). These services include makeup, eyelash extensions, nail artistry, hair styling, and related beauty treatments.
This Service Agreement is entered into between you (the “User”) and Stakelyn Group (Pty) Ltd, the company that owns and manages the GlowaGirlz Platform.
“GlowaGirlz” is an unregistered trade name fully owned by Stakelyn Group (Pty) Ltd, and any reference to “GlowaGirlz” in this Agreement refers to the platform, marketplace, online systems, and related services operated by the company.
By accessing or using our website, mobile application, franchise tools, or marketplace (“Platform”), you acknowledge and agree that:
• You are entering into a binding legal agreement with Stakelyn Group (Pty) Ltd; and
• You have read, understood, and agreed to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, you may not use the Platform.
2. Definitions
For the purpose of these Terms:

“Client” – An individual or business booking beauty services through the Platform.

“Service Provider” / “Artist” – A qualified, independent beauty professional offering beauty services through GlowaGirlz.

“Booking” – A confirmed appointment between a Client and a Service Provider for beauty services.
-
“Beauty Services” / “Services” – Beauty-related services offered through the Platform, including but not limited to makeup, lashes, nails, hair styling, and similar services.

“Marketplace Seller” – An independent business or individual selling beauty-related products through the GlowaGirlz Marketplace.
-
“Marketplace” – The online marketplace within the Platform that enables Sellers to list, market, and sell beauty products to Customers.
-
“Platform Fee” – An administrative or service fee retained by GlowaGirlz for facilitating Beauty Services and Marketplace transactions.
-
“User” – Any individual or entity accessing or using the Platform, including Clients, Service Providers, and Marketplace Sellers.
3. Eligibility
To use the Platform for Beauty Services or the Beauty Marketplace, you must:

Be 18 years of age or older

Have the legal capacity to enter into binding contracts

Provide accurate, complete, and truthful information at all times
Additional requirements apply depending on your role:

For Beauty Service Providers (Artists):

Complete identity verification and required checks
-
Comply with applicable health, safety, and licensing regulations

For Marketplace Sellers:

Complete identity and business verification as required
-
Provide accurate product listings and business information
-
Comply with applicable product, consumer protection, and regulatory requirements

GlowaGirlz reserves the right to deny, suspend, or terminate access to the Platform for any User who fails to meet eligibility requirements or violates these Terms.
4. Nature of Services
GlowaGirlz operates strictly as a facilitator and intermediary for both Beauty Services and the Beauty Marketplace.

GlowaGirlz does not employ Beauty Service Providers (Artists) or Beauty Marketplace Sellers.
-
Beauty Service Providers (Artists) operate as independent contractors and are fully responsible for their own taxes, insurance, licenses, legal compliance, and business operations.

Beauty Marketplace Sellers operate as independent businesses and are fully responsible for product sourcing, inventory management, pricing, shipping, and product quality.
GlowaGirlz does not directly provide beauty services or sell beauty products.
While GlowaGirlz cannot guarantee:

service outcomes or Artist performance within the Beauty Service operation, or
-
product quality, fulfillment, or delivery within the Beauty Marketplace operation,
the platform enforces vetting processes, platform standards, reviews, and quality control measures across both operations to help maintain trust, transparency, and service quality.
5. Bookings, Orders, and Confirmations
5.1 Beauty Service Booking Requests
Clients may request Beauty Services through the Platform by submitting:

Date and time of service

Selected service type (e.g., nails, hair, makeup, lashes)

Service location (if applicable)
-
Preferred Artist (optional)
Booking requests remain pending until accepted by the selected Artist.
Acceptance of a booking request may depend on:

Artist availability

Service type and preparation requirements
-
Location for mobile or house-call services
-
Compliance with the Artist’s service policies.
Same-day bookings may be accepted depending on Artist availability, and walk-in or last-minute requests may be declined at the Artist’s discretion.
5.2 Beauty Service Booking Confirmation
A Beauty Service Booking becomes valid only when:

The Artist formally accepts the booking request; and
-
Both the Client and the Artist receive official confirmation from GlowaGirlz via the Platform.
Once confirmed:

Both the Client and the Artist are expected to honor the booking.

Artists may provide services at a client’s location where mobile services are offered. Travel restrictions or location limitations may apply.
5.3 Late Arrivals
Clients are expected to arrive on time for their appointments.
Artists may apply a grace period for late arrivals. If a Client arrives late:

The service may be shortened to maintain the schedule
-
The appointment may need to be rescheduled
Artists may refuse service if lateness disrupts scheduled appointments.
5.4 Client Requirements and Preparation
Clients may be required to prepare for services according to the Artist’s instructions.
Preparation requirements may include:

Arriving with clean, detangled, or product-free hair
-
Bringing required hair extensions, tools, or materials
-
Completing any pre-service preparation requested by the Artist
Failure to meet preparation requirements may affect the service outcome or appointment eligibility.
5.5 Service Limits and Appointment Conditions
Appointment durations may be fixed based on the service booked.

Extended sessions may require prior approval from the Artist

Extra guests or assistants may not be allowed unless previously arranged

Certain services may require additional time or consultation
5.6 Age Restrictions
Certain beauty services may have minimum age requirements or require parental or guardian consent.
Artists may decline to perform services if age requirements or consent conditions are not met.
5.7 Health, Safety, and Right to Refuse Service
Artists may refuse to provide services if:

Clients do not follow service policies
-
Hair, skin, or scalp conditions are unsuitable for the requested service
-
Hygiene or safety standards cannot be maintained
This ensures professional standards and client safety.
5.8 Media and Recording
Artists may request permission to take photos or videos of completed work for portfolio or promotional purposes.
Clients may be restricted from recording services if the Artist’s policies prohibit it.
5.9 Special Service Instructions
Certain services, including chemical treatments or protective styles, may require:

Hair or skin assessments

Patch tests

Pre-treatment care instructions
Clients are responsible for following any instructions provided prior to the appointment.
5.10 Notes for Clients
Beauty service policies may vary depending on the Artist, service type, and service location.
Clients are encouraged to review and confirm the Artist’s specific policies before booking to ensure a smooth and professional service experience.
6. Cancellations & Refunds
6.1 Client / Customer Cancellations
Beauty Services (Client Cancellations)

Cancellation and rescheduling rules are determined by each Artist and may vary depending on the service type.

Clients may be required to provide advance notice to cancel or reschedule an appointment.
-
Late cancellations or no-shows may result in penalties as set by the Artist.
-
Policies regarding deposits (non-refundable, partially refundable, or transferable) are set by the Artist.
-
Clients should review and confirm the Artist’s cancellation policies before booking.
Beauty Marketplace (Customer Order Cancellations)
-
Orders may be canceled before the Seller confirms or ships the order, subject to Seller policies.
-
Once an order is confirmed or shipped, cancellation eligibility depends on the Seller’s stated return/refund policy and shipping method.

Transaction or processing fees may be non-refundable as determined by the Seller.
6.2 Service Provider and Seller Cancellations
Beauty Service Provider (Artist Cancellations)

Artists may cancel bookings based on valid reasons, including schedule conflicts or service limitations.

If an Artist cancels a confirmed booking, the Client is generally entitled to a refund of any deposit or prepayment according to the Artist’s policy.
-
Artists’ rules may include late cancellation penalties or restrictions on rescheduling.
-
Clients are encouraged to confirm all Artist-specific cancellation rules at the time of booking.
Marketplace Seller Cancellations

Sellers may cancel orders prior to confirmation or shipment, subject to their stated policies.
-
Customers may receive refunds based on the Seller’s return or refund terms if orders are canceled after confirmation.
6.3 Force Majeure

Neither Clients, Artists, Customers, nor Marketplace Sellers are liable for cancellations or delays caused by events beyond reasonable control, including illness, natural disasters, system outages, or government restrictions.

In such cases, GlowaGirlz may assist with:

Rescheduling Beauty Service bookings in coordination with the Artist
-
Facilitating fair refunds or alternative resolutions for Marketplace orders, including shipping or delivery adjustments

7. Payments and Fees
7.1 Payment Method
Beauty Services

All payments for Beauty Services bookings are made directly to the Artist.
-
GlowaGirlz does not collect, hold, or control payments, including deposits.
-
Cash or off-platform payments are allowed if agreed directly between the Client and Artist.
-
The platform’s role is to facilitate booking confirmations, not to manage or set pricing.
-
Service fees, deposits, and payment terms are entirely determined by individual Artists.
Beauty Marketplace
-
All payments for Marketplace orders must be processed through GlowaGirlz’ secure payment system.
-
Off-platform payments between Customers and Sellers are strictly prohibited.
-
Payments are held securely until the order is confirmed, processed, and shipped according to Marketplace or Seller-managed policies.
7.2 Charges, Disbursements, and Fees
Beauty Services

Prices, deposits, and any additional charges (e.g., for add-ons or special requests) are set by each Artist.
-
Artists may vary their policies regarding deposits (non-refundable, partially refundable, or transferable) and full payments.
-
Clients should confirm payment and refund policies directly with the Artist before booking.
Beauty Marketplace
-
Transaction fees and product prices are set entirely by the Marketplace Seller.
-
Optional platform-managed services (e.g., storage, packing, courier) may incur fees, but these are at the Seller’s discretion.
-
Clients and Customers must confirm pricing and any applicable fees directly with the Seller.
7.3 Refund Requests
Beauty Services

Refund eligibility is determined by the Artist’s deposit and refund policies, including rules for cancellations, late arrivals, and no-shows.

Clients should review and confirm refund rules directly with the Artist before booking.
Beauty Marketplace
-
Refund eligibility is determined by the Seller’s stated return/refund policies and shipping method.
-
Customers should review and confirm refund rules directly with the Seller before purchasing.
7.4 Tax Responsibility

Artists and Marketplace Sellers are fully responsible for:

Income tax
-
VAT (if applicable)
-
Compliance with local tax laws

GlowaGirlz does not deduct or remit taxes on behalf of Artists or Sellers.

8. User Responsibilities
8.1 Clients / Customers
Clients (Beauty Services) and Customers (Beauty Marketplace) must:

Provide accurate and complete details including location, timing, service requirements, or product information.
-
Maintain a safe, respectful, and professional environment during interactions.
-
Avoid harassment, discrimination, or abusive behavior toward Artists, Sellers, or other Users.
-
Not bypass the Platform by making off-platform payments or direct contact with Marketplace Sellers while beauty artist they can.
8.2 Beauty Service Providers / Artists
Artists providing Beauty Services must:

Arrive on time and deliver services professionally and safely.
-
Use hygienic tools and approved products, following health and safety standards.
-
Communicate clearly and promptly with Clients regarding bookings, cancellations, or rescheduling.
-
Comply with all booking, cancellation, and refund policies, as per Platform rules and their rules.
-
Maintain professional accurate portfolios, and service descriptions.
-
Adhere to health, hygiene, and sanitation guidelines at all times.
8.3 Beauty Marketplace Sellers
Marketplace Sellers must:

Provide accurate, complete, and clear product listings with correct pricing, descriptions, and applicable subscription tier features.
-
Fulfill and ship orders on time, either via Platform-managed or Seller-managed logistics.
-
Handle returns, refunds, or exchanges in accordance with Platform policies, including optional warehouse or shipping arrangements.

Comply with product safety, labeling, and regulatory requirements.
-
Maintain sufficient stock and quality control for all listed products.
-
Use Platform features, analytics dashboards, and promotional tools according to their Marketplace subscription tier.
9. Reviews and Ratings
9.1 Feedback

Clients (for Beauty Services) and Customers (for Marketplace orders) may leave reviews and ratings for Artists and Marketplace Sellers after a service is completed or a product is received.
9.2 Fair Use

All reviews and ratings must be factual, respectful, and non-defamatory.

GlowaGirlz reserves the right to remove or moderate harmful, false, or inappropriate content.
9.3 Artist & Seller Responses

Artists and Marketplace Sellers may respond to reviews, but responses must:

Remain professional
-
Not disclose personal or sensitive Client/Customer information

9.4 Use of Ratings
-
Ratings and reviews may be used by GlowaGirlz to:
-
Rank Artists and Marketplace Sellers on the Platform
-
Award verification badges or highlight top performers
-
Warn, suspend, or remove Artists or Sellers with consistently poor performance or repeated policy violations

10. Dispute Resolution

GlowaGirlz encourages all Users to resolve issues amicably between Clients/Customers and Artists/Sellers.

If unresolved, disputes may be escalated to the GlowaGirlz Support & Mediation Team.

Mediation decisions regarding Platform use, bookings, or Marketplace transactions are final and binding.
-
Any legal disputes fall under the jurisdiction of South African law.
12. Prohibited Conduct
Users of the Platform (Clients, Customers, Artists, and Marketplace Sellers) may not:

Harass, abuse, threaten, or discriminate against others
-
Provide false, misleading, or incomplete information
-
Manipulate ratings, reviews, or rankings
-
Circumvent GlowaGirlz payment systems
-
Sell illegal, unsafe, or non-compliant products (for Marketplace Sellers)
-
Use the Platform for fraudulent, unlawful, or prohibited purposes

13. Limitation of Liability
GlowaGirlz is not liable for:

Any injuries, damages, or dissatisfaction arising from Beauty Services provided by Artists

Product defects, delivery delays, or misrepresentation by Marketplace Sellers

Loss of income, profits, or indirect/ancillary damages related to Platform use
Where required by law, GlowaGirlz’ liability is limited to the total amount paid for the disputed booking (Beauty Service) or purchase (Marketplace order).
14. Account Suspension and Termination
GlowaGirlz may suspend or terminate accounts for any User (Clients, Customers, Artists, or Marketplace Sellers) who:

Violates these Terms

Engages in fraudulent, unsafe, or prohibited behavior

Misuses the Platform

Repeatedly cancels bookings or orders without valid justification

Fails to comply with Platform rules, quality, or operational standards

Providers may terminate their account by deactivating it, provided there are no pending disputes.
All obligations, including outstanding payments, fees, or refunds, remain binding after account termination.
15. Intellectual Property

All Platform content—including logos, branding materials, website design, images, systems, and training content—is the exclusive property of Stakelyn Group (Pty) Ltd.
Users may not:

Copy, reproduce, or modify any content

Distribute or sell Platform content
-
Use GlowaGirlz branding or intellectual property without written approval.
16. Amendments

GlowaGirlz may update or amend these Terms at any time to reflect changes in Platform operations, policies, or legal requirements.

Material changes will be communicated to Users via email or Platform notice.

Continued use of the Platform for Beauty Services or Marketplace activities constitutes acceptance of the updated Terms.
17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

All disputes arising from the use of the Platform—including bookings, orders, payments, or user conduct—fall under the jurisdiction of South African courts, unless resolved through GlowaGirlz-facilitated mediation or arbitration.
